And if it be stolen from him— The former verses make it very clear, that this restitution was only to be made in case the person, from whom the thing was stolen, did not make it evident, upon oath, that it was stolen without his knowledge or privity.

Exodus 22:12

12 And if it be stolen from him, he shall make restitution unto the owner thereof.
